The Information We Collect
For each visitor to our website, our web server automatically recognizes only the consumer’s IP address (where possible), but not the e-mail address.
We collect the e-mail addresses of those who: subscribe to our resources and/or newsletters, post messages to a bulletin board, make postings to our chat areas, communicate with us via e-mail or through our “contact us” form, or purchase products from our website. In certain situations, we also collect information related to IP address, including the city, state, and country in which it is located, as well as a browser’s User Agent. We also collect aggregate information on what pages visitors access or visit and information volunteered by the visitor, such as survey information and/or site registrations.
We may also collect information regarding purchases made via our website, such as, name, address, telephone number, fax number, and payment information.
How We Use the Information We Collect
The information we collect is used to improve the content of our website, customize the content and/or layout for each individual visitor, and notify visitors about updates to our website and/or product offerings.
Persons who supply us with their telephone numbers may receive telephone contact from us with information regarding new products and services. Persons who supply us with their e-mail address may receive e-mail from us with information regarding new products and services. We will not share your e-mail address with other organizations.
To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. Our site uses Secure Sockets Layer (SSL) technology to encrypt any passwords and credit card information that you enter. SSL secures your data while it travels from your computer to ours.
When you subscribe to our online newsletter(s), there are instructions at the bottom of your e-mail newsletter telling you how to unsubscribe if you ever wish to do so.
E-Mist may occasionally conduct user surveys to better target our content to our audience. We never share any of this information about specific individuals with any third party.
Emist.com is not directed to children under the age of 13. E-Mist does not knowingly collect or maintain information on children under the age of 13.
Sharing of the Information
This Agreement constitutes the entire agreement between E-Mist and you with respect to your use of and access to the Web Site. This Agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and E-Mist with respect to the Web Site. Use of the Web Site is unauthorized in any jurisdiction that does not give effect to all of the terms and conditions of this Agreement. Any cause of action you may have with respect to your use of and access to the Web Site must be commenced within one (1) year after the claim or cause of action arises. If for any reason a court of competent jurisdiction finds any provision of this Agreement, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give legal effect to the intent of the Agreement, and the remainder of this Agreement shall continue in full force and effect. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement or the Web Site to the same extent and subject to the same conditions as other business documents and records generated and maintained in printed form by E-Mist. The failure of E-Mist to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor bar E-Mist’s right to enforce the provision.
